Era perioada in care Romania a iesit din „epoca de aur” si a intrat in „epoca tepelor”. „Financiarul” va propune in fiecare saptamana
cate un dosar celebru, cu „autor necunoscut”. Astazi, despre cum au disparut „fara urma” 286 de nave.
Odata, demult, Romania „inventa” exploatarea la scara indus- triala a petrolului, nascocea primul avion cu reactie sau era intre primele trei tari care utilizau laserul in industrie. Ei bine, am fost mai mult decat atat, vorba poetului in viata – am avut si a noua flota maritima (comerciala) a lumii. O tempora, o mores…
La ora actuala, din toata flota romaneasca nu mai exista decat un munte de dosare penale care pluteste prin tribunalele patriei.

Prea multe nave

Revolutia din decembrie 1989, sau cum vreti sa-i spuneti, ne-a prins cu 286 de nave in stare de functionare, toate aflate in dotarea flotei maritime comerciale. Ele se aflau in administrarea fostei intreprinderi de stat Navrom Constanta. Asa cum am mai spus, dar ar fi bine s-o repetam de mai multe ori pe parcursul acestui material, in topul mondial al flotelor comerciale Romania ocupa atunci locul 9.
Insa o minte luminata s-a gandit ca o asemenea armada era de neconceput si greu de condus, asa ca, la data de 15 mai 1990, intreprinderea de stat a fost sparta in trei companii: Navrom, Romline si Petromin. Dintre acestea, Petromin a primit 89 de nave de cel mai mare tonaj, devenind segmentul strategic al flotei comerciale. Director general al companiei a fost numit Calin Marinescu, zis „Sogunul”. Trebuie spus ca, din cele 286 de nave, cel putin 90 se aflau in diferite stadii de degradare, scoaterea lor din uz fiind mai mult decat recomandata. Raman, totusi, mai mult de 190 de nave maritime bune si foarte bune care au disparut fara urma.

Fructul pasiunii

Pentru ca avea vapoare mai multe si mai bune, Petromin a starnit, la vremea ei, dorintele multor afaceristi, din tara si din strainatate. Si, asa cum se intampla cu orice lucru de care trage toata lumea, din compania in cauza s-a ales praful, in doar opt ani. Rand pe rand au disparut toate navele – unele vandute pe un dolar, altele sechestrate prin porturile lumii in contul unor datorii neachitate. Sigur, va tot intrebati de ani buni, ca si in alte cazuri, cine sunt vinovatii.
A existat si o ancheta penala, menita a face lumina in toata afacerea. S-a finalizat cu un dosar, celebru, „Flota” pe numele lui. Personajul principal era Traian Basescu, in calitatea sa de ministru al transporturilor in momentul in care navele au inceput sa intre in… „Triunghiul Bermudelor”. Nu era singurul suspect, ci a facut „echipa” cu alti 80 de acuzati.

„Financiarul” va prezinta dosarul „Flota” asa cum a iesit el pentru prima oara din „malaxorul” anchetatorilor. Veti vedea ca multe dintre deciziile luate de oficiali guvernamentali fata de navele romanesti au fost pur si simplu stupide, asta ca sa ne exprimam gingas. Altele pot fi catalogate drept rau intentionate. Ramane ca dumneavoastra sa judecati, pentru ca instanta a decis ca nu exista niciun prejudiciu in toata afacerea.
Retine atentia faptul ca dosarul ce il incrimineaza pe Traian Basescu (http://stareanatiunii.com/traian-basescu.html)de „scufundarea” flotei romanesti – cazul Petromin – nu a fost deschis de adversarii politici din PSD, ci de colegi din Partidul Democrat, chiar pe vremea cand Traian Basescu se afla la putere. Instrumentat pentru prima oara in 1999 (procuror general era chiar Mircea Criste, un fost membru PD), dosarul il acuza pe Traian Basescu de faptul ca, in 1991, in calitate de ministru al transporturilor, a semnat celebrul contract de asociere cu firma norvegiana „Klaveness” careia, practic, i-au fost vandute 16 nave maritime cu un dolar bucata. In urma acestui contract, partea romana s-a ales fara nave, dar si cu datorii de aproximativ 20 de milioane de dolari la o banca din Oslo.

Capetele de acuzare

Acuzatiile au fost constituite pe baza verificarilor facute de Directia Generala a Controlului Financiar de Stat la Compania de Navigatie Maritima Petromin SA Constanta. In dosar sunt consemnate urmatoarele ilegalitati: „In toate cazurile, infiintarea companiilor din strainatate (ale Petromin – n.r.) nu au avut aprobarea Guvernului Romaniei asa cum prevad dispozitiile Decretului-lege nr. 104 din 30 martie 1990.
Documentele de infiintare si functionare a acestor companii au fost aprobate de Basescu Traian – ministrul transporturilor. Navele apartinand Petromin SA Constanta au arborat pavilion liberian tot prin ordin al ministrului transporturilor, incalcandu-se astfel dispozitiile Decretului nr. 443/1972, ramas in vigoare pana la aparitia Ordonantei Guvernului Romaniei nr. 42 din 29 august 1997, cand a fost abrogat in mod expres de guvernarea CDR. Prejudiciul produs Petromin SA Constanta prin managementul necorespunzator in perioada 1991-1999 este estimat la peste 150 de milioane de dolari”.

Falimentul profitabil. Pentru cine?

Petromin a disparut in urma unor decizii menite a o face profitabila. Cel putin asa au sustinut cei implicati in afacere, in frunte cu Traian Basescu. Potrivit documentelor de la Parchet, in baza unei note a Ministerului Transporturilor (fara numar si data), pe 31 martie 1991 s-a stabilit necesitatea obtinerii unui credit de 45 de milioane de dolari pentru retehnologizarea a 15 nave apartinand Petromin. Peste nici doua saptamani, pe 11 aprilie, Traian Basescu, in calitate de ministru al transporturilor, semna la Oslo, impreuna cu reprezentantii Petromin si ai firmei norvegiene Klaveness, o scrisoare de intentie prin care se convenea infiintarea unei companii mixte romano-norvegiene, cu sediul in Liberia, pentru exploatarea a 16 nave romanesti. Conditia era ca partea norvegiana sa asigure obtinerea acelui credit de 45 de milioane de dolari necesar retehnologizarii navelor.

Zis si facut. La data de 14 mai 1991 s-a hotarat infiintarea companiei mixte Petroklav, cu sediul in Liberia. Ulterior, s-a renuntat la aceasta locatie, societatea fiind „mutata” in Bahamas, la data de 26 iulie 1991. Toate aceste demersuri au fost aprobate de ministrul Traian Basescu, fara ca acesta, sustine Parchetul, sa obtina si aprobarea Guvernului Romaniei, asa cum prevedea legislatia. De asemenea, navele din respectivele companii, care apartineau Petromin, au arborat pavilion liberian tot prin ordin al ministrului Basescu, desi dispozitiile in vigoare la acea vreme interziceau acest lucru. Managementul era incredintat prin contract firmei Klavenes”. In schimb, norvegienii s-au tinut de cuvant, au obtinut de la Christiania Bank din Oslo doua credite in valoare de 45 si, respectiv, 64 de milioane de dolari, imprumuturi garantate cu navele romanesti. Si pentru ca activitatea era asa de profitabila, pana in 1999, pentru a plati ratele creditului total de 109 milioane de dolari, au fost vandute zece din cele 16 nave cu care Petromin s-a asociat cu partenerul norvegian. Insa ghinion, mai ramasesera de platit 20 de milioane de dolari. Asa ca si celelalte sase nave s-au aflat in situatia de a fi arestate si vandute pentru ipoteca facuta de Christiania Bank. Potrivit datelor din dosarul „Flota”, compania Petromin nu a incasat niciun dolar din milioanele realizate de firma mixta romano-norvegiana in toata perioada 1991-1999. Iar ca tot circul sa fie complet, s-a descoperit ca in firma mixta constituita cu norvegienii, Traian Basescu a figurat ca director cand era si ministru al transporturilor.

„Din shipping nu se castiga. Se pierde”

Traian Basescu a sustinut intotdeauna ca navele implicate in contractul cu firma Klaveness au fost vandute formal cu un dolar catre o firma straina la care asociat unic era Petromin, pentru ca era obligatoriu acest lucru, deoarece o parte din nave reprezentau garantii suplimentare la creditul de 49 de milioane de dolari (desi in dosar figureaza un credit de 45 de mil. de dolari – n.r.). Niciodata nu a avut intentia de a instraina navele, iar dovada cea mai buna era, in viziunea actualului presedinte, faptul ca ele au ramas in inventarul Petromin, cu cheltuieli de amortisment. Vizavi de faptul ca s-a incredintat managementul unei alte firme nu pare a fi nicio problema pentru anchetatori atat timp cat firma romaneasca avea 50% din actiuni. Ramane insa o intrebare, daca era asa de bun contractul incheiat cu Klaveness, de ce Romania si-a pierdut navele si a ramas si cu datorii externe foarte mari? In urma cu aproape cinci ani (mai 2003), Traian Basescu declara presei ca „din shipping nu se castiga. Se pierde. Asta am aflat-o in 1995 de la norvegieni, cand am castigat o bursa si m-am specializat acolo. Eram si parlamentar, dar mergeam si la scoala. Ca sa faci bani cu nave trebuie sa stii cand sa le cumperi si cand sa le vinzi. Noi n-am avut asa o flota puternica si buna, cum se sustine. Era uzata sau prost facuta, pentru ca Ceausescu, in ultimii zece ani, a tinut mortis sa faca toate piesele in Romania. Nu au fost scoase la vanzare de frica, sa nu se aleaga cu dosar penal. Eu, ca ministru, nu puteam sa ma ocup de asa ceva. De astfel de lucruri trebuiau sa se ocupe Consiliul Imputernicitilor Statului si, din 1992, FPS-ul. Nu am fost directorul firmei mixte cu norvegienii, am fost presedintele onorific al consiliului de administratie. Pentru o astfel de functie onorifica nu esti platit. Eu n-am fost platit de norvegieni. Am auzit ca mi-au cautat si conturi in strainatate. N-au gasit, ca n-au ce sa gaseasca. Totul este politic. Au incercat si in 1993, a incercat si Emil Constantinescu sa ma infunde. Acum se incearca din nou. Am mai auzit ca au pus un expert – Nicu Oprea – sa faca asta, pentru ca el avea un dosar penal. Acum, acest Oprea nu mai este in tara. A facut expertiza si a fost lasat sa plece. Asa am auzit. Nu sunt vinovat si nici nu ma intimideaza cu dosarul lor”.

Si totusi, unde sunt vapoarele?

Traian Basescu a fost sau nu vinovat, asta nu o vom afla niciodata. La un moment dat insa, a scapat o pista foarte interesanta catre anchetatori. El a declarat ca navele cele mai bune din contractul cu Klaveness au ajuns la un membru PSD si la un taranist. „S-au batut pentru ele. Ei le-au cumparat”, declara Traian Basescu.
Niciuna dintre institutiile statului nu a mers pe aceasta idee, a gasirii „corpului delict”. Surse politice ne-au confirmat insa partial declaratiile din urma cu cinci ani, facute de actualul presedinte. Cel putin 25 dintre navele Petromin apartin unor armatori romani, acum importanti oameni de afaceri in judetul Constanta.
Concluzia este una trista pentru noi, hilara pentru cineva „din afara”. Aproape 300 de nave au disparut, dar nimeni nu este vinovat. Nu exista prejudiciu, nu exista fapta penala. Pentru amuzamentul dumneavoastra sa va pomenim despre cazul unui sef de serviciu la Navrom, acuzat de abuz in serviciu, fals intelectual si uz de fals. In timp ce era cercetat penal a reusit performanta sa devina… director economic la Penitenciarul Poarta Alba, cu gradul de maior. Justitia romana poate fi mandra ca, asemenea savantilor care au cutreierat Triunghiul Bermudelor, a emis doar teorii judiciare. Lipseste doar ipoteza extraterestrilor si a portii catre o alta lume…

Romline si Navrom, giranti pentru SRL-uri

Companiile nationale maritime Romline si Navrom au fost mult timp si principalii datornici aflati pe lista Agentiei pentru Valorificarea Activelor Bancare (AVAB) care preluase problemele Bancorex. Astfel s-a ajuns si la declansarea falimentului celor doua companii pentru a se putea recupera sume cat mai mari prin arestarea si executarea navelor care umblau hai-hui pe oceanele lumii. Romline si Navrom au avut calitatea de codebitor pentru un mare numar dintre creditele luate de diverse (http://stareanatiunii.com/diverse.html) firme de la Bancorex. De exemplu, Navrom a garantat cu nave proprii creditele obtinute de 27 de societati private, iar pentru 11 companii private a preluat integral datoriile rezultate din creditele luate de la Bancorex.
Si Romline a garantat cu navele proprii creditele obtinute de sase companii private de shipping, pentru trei dintre acestea preluand integral datoriile rezultate din conventii de credit incheiate cu Bancorex. De altfel, multe credite au fost luate de la Bancorex de niste SRL-uri ce aveau denumirea „shipping” in coada, dar care
nu aveau flota proprie, ci foloseau nave inchiriate.

Printre cei trimisi in judecata pentru comiterea unor fapte penale „in legatura directa cu modul defectuos in care si-au exercitat,cu stiinta, atributiile de serviciu” sunt fostii ministri ai transporturilor, Paul Teodoru si Aurel Novac, fostul presedinte al Fondului Proprietatii de Stat, Radu Ovidiu Sarbu, fostii secretari de stat Calin Dragomir Marinescu, Gheorghe Adrian Marinescu si Viorel Oancea


In 2005, procurorii DNA au separat faptele lui Traian Basescu de cele ale restului inculpatilor, motivandu-se ca seful statului beneficiaza de imunitate


In septembrie 2007 a fost finalizata o expertiza care a costat 140.000 de lei, prin care s-a tras concluzia ca nu a existat prejudiciu in dosarul „Flota”


In urma ultimei expertize realizate in februarie 2008, toti cei pusi sub acuzare au fost scosi de sub urmarire penala. Cu exceptia lui Traian Basescu. Este insa greu de crezut ca dupa ce nu va mai fi presedintele Romaniei va mai fi acuzat de ceva intrucat nu exista… prejudiciu

Este evident ca aceeasi soarta au avut-o si alte nave din flota romaneasca. De exemplu, un alt dosar care a starnit reactii in lant a fost cel al privatizarii Companiei Romane de Pescuit Oceanic (CRPO). In urma unei anchete a fost descoperita o intreaga contrabanda cu nave aflate in patrimoniul companiei. Ca si in cazul Petromin, dosarul CRPO ascunde, dincolo de evidentele abateri de la lege comise de managerul societatii si de cumparatorii „strategici”, acte de coruptie necercetate pana la capat. Concluziile anchetei conduc catre varfurile FPS si chiar mai departe.
Compania a fost vanduta de FPS, care detinea 51% din actiuni, catre grecii Ioannis Dimakos si Theodoros Lades contra sumei de un milion de dolari catre sfarsitul anului 1997. Cu toate acestea, grecii au avut puterea sa valorifice patrimoniul CRPO, in urma unui acord semnat de acestia cu conducerea FPS, inca de la jumatatea anului 1997. La acea data, fusese demarata procedura de declarare a falimentului societatii pentru ca nu putea onora o datorie de opt milioane de dolari catre o banca austriaca. Cercetarile politiei au scos la iveala un lung sir de falsuri in acte si vanzarea pe nimic a flotei romanesti de pescuit oceanic.
Rechizitoriul intocmit in 1998, prin care erau acuzati Ion Crisan, fost manager al CRPO, incepand cu 12 aprilie 1996 si pana la sfarsitul anului 1997, Theodoros Lades si Ioannis Dimakos, cumparatorii companiei, aduce in atentie responsabilitatea si „contributia” sefului de atunci al FPS, Sorin Dimitriu. Logic, nu a fost incriminata nicio fapta a acestuia. Singura piesa „cazuta” a fost un simplu expert FPS. De asemenea, din ecuatie face parte Ministerul Industriei, care a emis avize pentru scoaterea din tara a doua nave sub pretextul unor necesare reparatii care ar fi trebuit facute intr-un port din Grecia. Potrivit acelorasi cercetari, Tribunalul Tulcea l-a numit administrator al CRPO pe Ioannis Dimakos in decembrie 1997, fara a verifica daca acesta a achitat pretul actiunilor cumparate de la FPS (termenul-limita era 12 ianuarie 1998). Totodata, Tribunalul Tulcea a inclus pe lista creditorilor CRPO firma Harmony Shiping International SRL din Constanta, ai carei patroni erau Dimakos si Lades, fara sa existe documente care sa ateste aceasta calitate.

Flota nu mai exista ! ca multe bunuri ,proprietate publica a acestui stat! Dar vapoarele sunt sigur ca inca functioneaza si fac profit! Cuvantul care le place celor de la guvernare
